Most frequent divorce questions and answers

An Uncontested Divorce is a proceeding in which two married people have no outstanding issues and are ready to sign documents for the court to consider. If there are any issues, including support or custody, anything having to do with property, or any issue whatsoever, the Divorce is Contested. Most divorces start off contested and after some work between the parties, end up being Uncontested Divorces. 

Most Divorces are Contested, despite what anyone may tell you. If there are any issues whatsoever, or there is property or their are children involved, there are most likely some matters that still have to be worked out. In a nutshell, a Contested Divorce is a Divorce in which there are still some issues to be worked out.

Sometimes, people start working with one lawyer and decide to replace that lawyer. Other times, it is the lawyer opts not to continue the representation. While there are many firms that are happy to enter such cases, we often decline to do so. There are plenty of instances in which our firm has been retained as new counsel in a legal matter, but this is not something that we do regularly. Often, we find that people who start their representation with other attorneys have already had their attorney/client experiences tainted in such a way that they come to us with weakened positions, missed deadlines, anger, & unrealistic expectations. In some cases, we can make the case better and in some cases, we can bring no value. Accordingly, we frown upon taking cases that have been handled by other attorneys subsequent to our being contacted. We have been informed of plenty of firms that will happily take a case as new counsel with no questions asked in exchange for compensation. While our policy may anger some people we encounter, it allows us to ensure that we can provide an optimal client experience for those clients that have chosen to work with us.

Like many other law firms, we have no desire to compete with people selling divorce forms. We provide a completely different service. The product we provide is legal representation. Our opinion is, if you want someone to just fill out forms for you, forms that you can download for free on the internet, then that is your right.

However, we do have concerns that people don’t know that they can get those forms for free. We are confident in the value we bring with the services we provide. It is concerning that people in our communities may be susceptible to the predatory practices of entities selling forms filled out by non-attorneys, which can be downloaded for free.

Due to the alarming discovery that many people contacting us had been in touch with people or entities that were providing transcription services rather than legal services, we have created additional resources.

Jamel Oeser-Sweat, Esq.

Managing Attorney

Jamel Oeser-Sweat is a graduate of St. John’s University School of Law. He attended New York University as an undergraduate. He has been named a “Rising Star” by the New York Law Journal. He is the Co-Author of DNA: Forensic & Legal Applications, the forward of which was written by Nobel Prize Winner James Watson.

He is currently the President of the Board of Directors of the Supportive Children’s Advocacy Network (SCAN). The agency currently has over 100 full-time and 300 part-time employees with an annual budget of approximately $14 million. His work with SCAN was recently featured on Channel 13/PBS in a Treasures of New York Segment which was nominated for an Emmy Award.

Jamel is admitted to practice in the New York and New Jersey State Courts. He is also admitted to practice in the following Federal Courts: the United States Supreme Court, United States District Court for the District of New Jersey, the United States District Court, District of Vermont, the United States District Court, Southern District of New York, and the United States District Court, Eastern District of New York. He has also been admitted to practice before the United States Patent and Trademark Office.
